Terms of Service for DailyInk

DailyInk is a daily journaling platform operated by LifeEcho LLC, a technology company that provides writing and journaling services. Users can create and store daily journal entries, which can be accessed and managed over time.

By using DailyInk, you agree to the following terms. These Terms apply to all users unless otherwise specified.

1. Service Description

DailyInk allows users to create and store daily journal entries through a web-based platform, which are processed and stored on our secure platform. The platform is powered and maintained by LifeEcho LLC.

DailyInk is committed to making our services accessible. If you need assistance using the platform due to a disability, please reach out to us at support@lifeecho.org. If you require alternative access to your entries, we will do our best to accommodate your needs. DailyInk aims to comply with the Americans with Disabilities Act (ADA) and other applicable accessibility regulations.

DailyInk is not intended for medical, therapeutic, or emergency communication purposes. If you are in distress or need urgent help, contact appropriate emergency services.

2. Eligibility

You must be at least 13 years old to use DailyInk. By using the service, you affirm that you meet this age requirement.

3. Scope of Use

DailyInk is available to all users. Some users may be referred through community organizations for sponsored access. Eligibility for such access is managed by the referring organization. While a partner may help facilitate use of the service, LifeEcho LLC remains the platform provider and custodian of your data.

4. User Accounts

• You are responsible for keeping your account credentials secure.
• You agree to provide accurate, current, and complete information during signup.
• You may not use the service for unlawful or harmful purposes.

5. Journal Entries and Content

• You retain ownership of your journal entries.
• You grant DailyInk permission to store, process, and allow access to your entries as described in our Privacy Policy.
• All entries are securely stored and managed by LifeEcho LLC.
• You are responsible for the content you create and share using DailyInk.
• You are responsible for ensuring that any individuals you mention in your entries have given appropriate consent, in compliance with your local laws.

6. Subscription and Billing

• Some users are billed directly by LifeEcho LLC, while others may receive sponsored or facilitated access through community organizations. Regardless of billing path, LifeEcho LLC remains the provider of the service and responsible for storage and delivery.
• Payments are processed securely through trusted third-party providers such as Stripe. In some cases, payments may be handled by a partner organization using their own merchant account.
• If payment fails or is canceled, access to new entries may be paused until resolved.
• You may purchase additional storage or features beyond your base subscription. Pricing and package options are listed on our Pricing Page and may change from time to time.
• Refund Policy: All purchases are final and non-refundable unless otherwise required by applicable law.

7. Data Retention and Ownership

Recordings from free plans are currently preserved for up to 10 years. This retention period is subject to change based on operational, legal, or policy updates. We will notify users if this policy is updated in a way that affects their data.

Paid plans include lifetime storage ("Forever" storage). For the purposes of these Terms, "Forever" means for as long as LifeEcho LLC continues to operate and offer the DailyInk service. If the service is ever discontinued, we will make reasonable efforts to notify you in advance and provide an opportunity to download your entries before permanent deletion.

LifeEcho LLC manages all data and maintains secure, compliant storage environments in accordance with industry standards. We do not warrant that content will be preserved without loss, corruption, or error at all times, and you are solely responsible for maintaining independent backups of your data.

Users may request deletion or export of their entries and data at any time by contacting support@lifeecho.org. Deletion requests will be honored within a reasonable time unless retention is required by law or operational necessity.

8. Branding and Attribution

DailyInk is powered by LifeEcho LLC. Communications and materials may include acknowledgments of community partners where applicable.

9. Termination

We reserve the right to suspend or terminate your access to the service, in whole or in part, at our sole discretion, with or without notice, if we believe you have violated these Terms, misused the platform, engaged in unlawful activity, or otherwise acted in a way that could harm DailyInk, other users, or third parties.

Upon termination for cause, you will immediately lose access to your account and all associated entries and content, and we may permanently delete such data without any obligation to provide a copy. We are not liable to you or any third party for such termination or deletion.

If we terminate the service or your account for reasons other than your breach of these Terms, we will make reasonable efforts to provide advance notice and an opportunity to download your data before it is permanently deleted.

You may cancel your account at any time by contacting support@lifeecho.org. If you cancel, your entries will remain accessible for a minimum of 30 days unless you request immediate deletion. After that, they may be scheduled for permanent deletion.

10. Limitation of Liability

LifeEcho LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the service. Although strong security protocols are in place, we cannot guarantee absolute protection from unauthorized access or data breaches. Use of DailyInk is at your own risk.

We are not liable for delays or failures in performance due to events beyond our reasonable control, including but not limited to acts of God, labor disputes, war, terrorism, internet or hosting failures, power outages, supply-chain disruptions, vendor failures or discontinuations, government actions or regulations, court orders, public health events, or natural disasters. These constitute force majeure events.

11. Third-Party Services

DailyInk uses third-party services such as Stripe, Microsoft Azure, and other cloud providers. Use of the platform may be subject to the terms of those providers. We are not responsible for their services, performance, or policies.

The availability and functionality of DailyInk depends on these providers. Outages, policy changes, deprecations, rate limits, or business decisions by third parties may affect the service. We are not liable for interruptions or changes caused by such providers.

12. Modifications and Discontinuation of the Service

We may update, suspend, or discontinue parts of the DailyInk service at any time. Where feasible, we will provide notice of major changes. However, we are not obligated to maintain any specific feature indefinitely.

We may discontinue the service entirely at any time. In such event, we will make reasonable efforts to provide advance notice and an opportunity to download your data, but we have no obligation to continue providing storage or access after discontinuation.

13. Changes to These Terms

We may revise these Terms from time to time. If significant changes occur, we will notify you via email or a message on our website. Continued use of the service constitutes your acceptance of the updated terms.

15. Dispute Resolution

If you have a concern or dispute regarding DailyInk, we encourage you to contact us first at support@lifeecho.org so we can try to resolve it informally.

If a dispute cannot be resolved informally, it will be governed by the laws of the Commonwealth of Virginia. Any legal action must be brought in the state or federal courts located in Richmond, Virginia. In some cases, both parties may mutually agree to resolve disputes through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Richmond unless otherwise agreed.

Class Action Waiver: You agree to resolve disputes with DailyInk on an individual basis and waive your right to participate in class action lawsuits or class-wide arbitration.

16. Communications and Consent

By using DailyInk, you consent to receive communications from us via email related to your use of the service. These may include service reminders, account updates, support follow-ups, or promotional messages.

You can opt out of promotional messages at any time by following the unsubscribe instructions included in those messages. However, you may still receive essential service-related messages even if you opt out of marketing communications.

17. Feedback and Improvements

We welcome your feedback to help improve DailyInk. By submitting feedback or suggestions, you grant us the right to use that input without obligation or compensation, unless otherwise agreed in writing.

18. Indemnification

You agree to indemnify, defend, and hold harmless LifeEcho LLC and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the service; (b) your content; (c) your violation of these Terms; or (d) your violation of applicable laws or the rights of any third party.

19. Disclaimer of Warranties

THE SERVICE AND ALL RELATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM LOSS OF DATA.

20. Miscellaneous

Survival. The provisions of these Terms that by their nature should survive termination (including, without limitation, ownership, user content licenses to the extent necessary for operation, warranty disclaimers, indemnity, limitations of liability, dispute resolution, and this Section 20) shall survive termination.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Failure to enforce any provision is not a waiver of our right to do so later.

Entire Agreement. These Terms constitute the entire agreement between you and LifeEcho LLC regarding the service and supersede all prior or contemporaneous agreements on the subject matter.

Headings. Headings are for convenience only and do not affect interpretation.
